The client and its employees explicitly understand and agree that your use of Silver Oak Health’s services is at your risk and that the services are provided “as is” and “as available” without warranty of any kind, either expressed or implied, that is not explicitly stated. Additionally, no advice or information, whether oral or written, obtained by you from Silver Oak Health shall create any warranty that is not expressly stated in the service agreement. In no event shall Silver Oak Health be held liable to you or any third party for any damages including, but not limited to, indirect, special, incidental or consequential damages or other losses. The client and its employees and any third parties, agree to indemnify and hold harmless Silver Oak Health services from any damages claimed as a result of services. Products, information and resources obtained from Silver Oak Health shall not be held liable based on any theory of liability including breach of contract, breach of warranty, tort (including negligence), services liability or otherwise, even if Silver Oak Health or its representatives have been advised of the possibility of such damages and even if a remedy set forth by Silver Oak Health is found to have failed of its essential purpose.
While SOH undertake commercial reasonable efforts to provide the services to “client”, Silver Oak Health cannot and not represent, warrant or guarantee that Silver Oak Health will be able to do so in full at all times or at any particular time, nor Silver Oak Health represent, warrant or guarantee that Accordingly Silver Oak Health use of services is expressly conditioned on service agreement.
Silver Oak Health does not have any commercial interest either directly or indirectly from any service providers. Silver Oak Health has a pure intention to provide right and reliable information to support the employee or client. The referral information provided by Silver Oak Health is in good-faith and is review based data points. It is advised that client may hold due diligence and use their judgment in finalising the services.
Silver Oak Health is not responsible or liable for any damages for of a person or property or theft of any property belonging to the client directly or indirectly. Silver Oak Health is not liable to reimburse the item or value of the loss or damage or theft caused during the course of service or by the referred vendor.
